WRAACReunited Terms and ConditionsThis Agreement governs our relationship with users of the WRAACReunited web site (“the Site”). By using or accessing the Site, you agree to these terms and conditions. You acknowledge that WRAACReunited may in the future change hands, including to become an incorporated body, and agree that this Agreement will be transferable from the current operator of WRAACReunited to any new entity without requirement of notice.] 1 Introduction1.1 This Agreement incorporates the WRAACReunited Privacy Policy, available here. It also incorporates the WRAACReunited Acceptable Use Policy, available here. These policies contain important information, and should be read before progressing with this document. 1.2 You must take the time to read and understand this Agreement before registering for the the Site. By registering, you accept that you are entering into a contract with the Owner and WRAACReunited. 1.3 The Owner and WRAACReunited reserves the right to change this Agreement, and the incorporated policies, from time to time, and post the new version of this Agreement on the Site. Users should regularly check the terms and conditions, including the incorporated policies. 1.4 This Agreement, and any new version of it in the future, takes effect immediately. Your continued use of the Site after any variation of these terms and conditions, or variation of the related policies, by WRAACReunited constitutes your acceptance of the terms of the Agreement as it then stands. 1.5 If you do not agree to be bound by the terms of any new version of this Agreement, do not continue to use or access the Site. 2 Accessing the Site2.1 To access the Site, you must be at least 18 years of age and be a former or current service woman of the Australian Defence Force (ADF). By using the Site, you represent and warrant that you are: (a) 18 years or older; and (b) A former or current service woman of the ADF. Any use of the Site by anyone under the age of 18 who is not a former or current service woman of the ADF, is strictly prohibited and is in violation of this Agreement. 2.2 Please note that neither the Owner or WRAACReunited is an internet service provider. To avail yourself of the Site, you must have internet access and all the software (and skills) required for email and web usage. 2.3 The Site may be temporarily unavailable from time to time for maintenance or other reasons. 2.4 The Owner and WRAACReunited assume no responsibility for any omission, interruption, error, delay, deletion, or defect in operation of the Site or the facilities the Site provides. 2.5 The Owner and WRAACReunited are not responsible for any technical malfunction or other problem in connection with any technical problems or traffic congestion on the Internet, including injury or damage to your or to any other person's computer or other hardware or software, related to or resulting from using or downloading materials in connection with the Internet and/or in connection with the Site or any Third Party Sites (defined in clause 8 below). 3 Registration3.1 In consideration of the Owner and WRAACReunited allowing your use of the Site, you will:- (a) register for the Site using true, accurate and current information about yourself - including your correct name, address and any other requested details (“Profile”); (b) maintain the accuracy of your Profile by promptly notifying us when there is a change to your Profile by making the necessary amendments to your Profile and all other parts of the Site where you enter information. It is particularly important that the email address we hold for you is kept up-to-date and that you have full access to it as we will be sending you important messages to your email address; (c) maintain at all times the confidentiality of your password and not disclose your password to any third party. Please note that for security or other reasons, we may require you to change your password or other information which facilitates access to the Site; (d) be responsible for the use of your member account including all actions that take place using your account; and (e) notify us immediately if you suspect there has been unauthorised use of your member account. 3.2 Users who are eligible to register and are registered in accordance with the terms of this Agreement on the Site are known as “Members”. 3.3 As part of the registration process, you will receive a verification email, the purpose of which is to take reasonable steps to ensure that the email address you have nominated during registration is controlled by you. That email contains simple instructions which you must follow. 4 Intellectual Property Rights4.1 The Owner and WRAACReunited do not claim ownership rights in the content, information, pictures, images, sounds, videos, graphics, software, files, or any item whatsoever that you or any other Member posts on the Site or otherwise makes available or accessible to other Members or users of the Site (“Content”). If you post Content in accordance with the terms of this Agreement, you will retain all intellectual property rights in that Content subject to the licence granted by you to us under clause 4.2 below; 4.2 By submitting Content, you: (a) are representing and warranting that:- (i) you are fully entitled to do so; (ii) you are the sole owner of the Content or are otherwise authorised by the owner of the Content to post the Content on the Site; (iii) the posting of the Content on the Site will not violate the rights (including intellectual property rights) of any third party or any applicable laws; (iv) the Content will comply with this Agreement, including the Acceptable Use Policy; (b) grant the Owner and WRAACReunited a perpetual, non-exclusive, royalty-free, sublicensable, non-terminable, worldwide licence to copy, modify, reproduce, distribute, show in public and create derivative works from the Content in any way; and (c) authorise us to adapt the Content at our discretion;, and (d) authorise us to identify you as the author of the Content in question. 4.3 You agree to pay for all fees, royalties or any other payments owing to any third party by reason of your posting of the Content. 4.4 Except to the extent that copyright, trade marks, and other intellectual property rights are embodied in Content not placed on the Site by the Owner and WRAACReunited, you acknowledge that all copyright, trade marks, and other intellectual property rights in, on and relating to the Site (including but not limited to the WRAACReunited designs, text, graphics, pictures, information, applications, software and other files, and their selection and arrangement), are owned by the Owner and WRAACReunited and our licensors (the “WRAACReunited Material”). 4.5 It is easy to copy material which appears on web sites, but this does not mean it is legal to do so. Therefore, you may not copy, reproduce, modify, distribute, show in public or create any derivative work from or use the WRAACReunited Material, or any other material which is found on the Site without the prior written approval of the Owner and WRAACReunited. 4.6 In using any WRAACReunited Material you acknowledge the personal and emotional significance of the information on the Site. 4.7 You must not copy or otherwise use the WRAACReunited name, associated marks, or other intellectual property of WRAACReunited (including, but not limited to, logos, mottos, graphics, sounds, or literary works) without the prior written approval of WRAACReunited. 5 Member Conduct and Termination5.1 You agree to use the Site only for your personal non-commercial use. 5.2 The Site is intended to be used by its Members for the purposes referred to in this Agreement. Accordingly, you must not use the Site generally in an unlawful manner or in a manner that breaches this Agreement (including the Acceptable Use Policy and Privacy Policy). 5.3 If you breach any clause of this Agreement we may terminate your Membership with or without notice to you. 5.4 We reserve the right in our sole discretion: (a) to suspend or terminate your or any Member's access to the Site, or parts of it; andr (b) to remove, or require you or any other Member to remove Content, if you or the relevant Member or Content appears to us, or to a complainant, to be in breach of any provision of this Agreement. 5.5 If your access has been suspended or terminated you must not re-register for, or re-access, the Site without our prior consent. 5.6 You are responsible for everything which is done on or through the Site: (a) while your Membership account is logged on to the or through the Site in your Membership Account; or (b) through your email address(es) in relation to the Site. 5.7 Where we reserve a right in this Agreement, it does not mean we are obliged to exercise it. Also, you acknowledge that given the open-access nature of the Site, we cannot prevent determined people whose Membership has been suspended or terminated from re-accessing or re-registering as Members, in breach of their obligations under this Agreement. 6 Creating a Member Account6.1 You may create, manage, operate and maintain your Member account by:- (a) finding and adding friends from your email address book provided that those friends are former or current servicewomen of the ADF; (b) requesting to add other Members as friends and accepting friend requests from other Members; (c) managing the privacy of your profile page by classifying your friends as “Friends”; (d) posting your name, profile notes, photos, videos, messages, material and commentary on your profile page; (e) accessing the profile pages of your friends; (f) posting comments on your friends’ Member profile pages; (g) receiving emailed messages, which will be stored in your WRAACReunited inbox. Notification of receiving a message will be sent to the email address contained in Members' “My Profile” page; (h) opening and reading messages received into your WRAACReunited inbox; (i) sending emails to other Members; (j) joining site groups; and (k) posting updates of your activities on your Profile. 6.2 The above list of functions is not exhaustive and there may be additional functions available on the Site. The Owner does not represent that the functions listed will always be available and reserves the right to remove functions in its sole discretion at any time. 6.3 From time to time, the Owner may offer new or additional services through the Site. Your use of those services may be subject to additional terms and conditions, or rules of use, which you must comply with. Any failure by you to comply with a material provision of the terms or rules governing such additional services will amount to a breach of this Agreement and enable us to terminate this Agreement with you. 7 Joining a Group7.1 A Group is a publicly available place on the Site dedicated to a particular situation such as a Posting, Training Establishment, Barracks or Mess, Exercise, Special Group or a General Group of interest (“Group”). You may join a Group in which you have an interest, provided however that you may only join the Group to which you belong, or once belonged, at the relevant time 7.2 Once you have joined a Group, you become a Group Member and:- (a) may post your name, photos, videos, messages and material on the Group Page; (b) an update notification is sent to the owner of the Group notifying them of your joining; (c) may receive by email a notification when a new person has registered on a Group if you are the Group Owner. (d) may send and receive emails from other Group Members. 8 Your Privacy8.1 By agreeing to this Agreement, you give your consent to the way the Owner may handle your personal data. Given the global nature of the World Wide Web, any posting on the Site (including any which contain personal information) is, of course, accessible to Internet users around the world; 8.2 You have the ability to control which other Members have greater access to your Profile page than others. Any Member can view the elements of your Member profile pages that you do not select to be accessible only by “Friends”, and this also applies to the Groups to which you belong. 9 Alerting Us and Removal of Content9.1 You acknowledge that we are not and cannot be responsible for the Content or behaviour of other Members - whether on the Site or outside of it. We only provide a venue where the facilities of the Site may be accessed. 9.2 If you see anything on the Site which appears to breach any clause of this Agreement, then please contact us to inform us of this conduct [using the “Report” function, or] by emailing us [through the “Contact Us” facility] at This e-mail address is being protected from spambots. You need JavaScript enabled to view it . 9.3 You acknowledge that the Owner and WRAACReunited does not monitor or approve Content, and so they are reliant upon users to point out any conduct which breaches or may breach this Agreement. Although the Owner and WRAACReunited provide rules for Members’ conduct and Content postings, the Owner and WRAACReunited do not approve or control and are not responsible for what Members post, transmit or share on the Site and are not responsible for any inappropriate, obscene, offensive, unlawful or otherwise objectionable Content you may come across on the Site. 9.4 You acknowledge that the Owner and WRAACReunited may delete or remove any Content, or move any Content from a place on the Site, without notice and the Owner’s sole discretion, for any reason, without having to provide reasons,. You are solely responsible at your sole cost and expense for creating backup copies and replacing any Content you post or store on the Site or provide to us. 10 Third Parties10.1 The Site contains links to third party websites (“Third Party Sites”). the Owner and WRAACReunited have no control over the content of Third Party Sites and accepts no responsibility for those Sites, their content or for any loss or damage that may arise from your use of them. You acknowledge that you access and use Third Party Sites from the Site at your own risk. 10.2 You specifically acknowledge that you are no longer protected by any rights accruing under this Agreement, including the incorporated policies, when visiting Third Party Sites. 11 Disclaimer and Release11.1 The Site, and the Content are provided "as-is". 11.2 The Owner and WRAACReunited cannot guarantee and does not promise any specific results from use of the Site. 11.3 The site is not hosted by the Owner or WRAACReunited and access to any part of the Site is subject to the independent provision of hosting by the host. The Owner and WRAACReunited are in no way liable for any disruption to this Site, whether or not such disruption is caused by the host. 11.4 The Owner and WRAACReunited do not represent or warrant that the software, Content or materials on the Site, or any related, linked, or directed Third Party Sites, or any other thing are accurate, complete, reliable, current or error-free or that the Site and the hosting site servers are free of viruses or other harmful components. Without limiting the foregoing in any way, you understand and agree that you download content or otherwise obtain content, material, data or software or any other thing from or through the Site at your own risk and that you will be solely responsible for your use of this content material, data or software including any damage, loss of data, or any other harm of any kind that may arise. 11.5 The Owner and WRAACReunited disclaim any and all representations and warranties, whether express or implied, including implied warranties of title, merchantability, fitness for a particular purpose or non-infringement. 11.6 The Owner and WRAACReunited accept no responsibility for the truth or accuracy of any material available on the Site, whether provided by Members or others. Content and any other information and material available on the Site is not intended to amount to advice on which anyone should place any reliance. The Owner and WRAACReunited disclaim all liability arising from any reliance placed by any person (whether or not a Member) on material available on the Site. 11.7 You should exercise no lesser degree of caution in appraising what you see on the Site than you do offline. 11.8 You acknowledge that even though Members are prohibited from doing so, they may provide information, or otherwise behave, in a way that is unreliable, misleading or even illegal. Further, you acknowledge that people may not necessarily be who they say they are. 11.9 You acknowledge that images may be posted of persons who are now deceased. 12 Excluded loss12.1 In no event will the Owner and WRAACReunited, and our directors, officers, employees, volunteers, site buddies, moderators, and agents be liable to you or any third party for any direct, indirect, special, consequential, exemplary or incidental loss or damage, or for any loss of data, profit, revenue or business, arising from your use of the Site, Content, information, or other materials on the Site, even if we have been advised of the possibility of such loss or damages. 12.2 The Owner and WRAACReunited, and our directors, officers, employees, volunteers, site buddies, moderators, and agents will also not be liable for any failure to perform any of our obligations under this Agreement caused by matters beyond the Owner’s and WRAACReunited’s reasonable control. 13 Maximum LiabilityWithout limiting the preceding clause, the Owner’s and WRAACReunited’s aggregate liability under this Agreement (whether arising in negligence or otherwise) will not under any circumstances exceed [one hundred dollars Australian ($100). You acknowledge that this limit stands on its own and is applicable even in cases where all or part of the Agreement is read down, severed, or subject to an implied or express limitation at law. 14 IndemnityYou agree to indemnify and hold the Owner and WRAACReunited and their affiliates harmless from all loss, liabilities, claims, demands and expenses (including reasonable legal fees) made by any third party that may arise from any breach of this Agreement by you or through a machine on which you access the Site or otherwise in relation to any software or Content you post or share on the Site or via the Site. 15 Assignment15.1 The Owner reserves the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement. 16 Entire Agreement16.1 This Agreement includes the WRAACReunited, Privacy Policy and the Acceptable Use Policy. Together these documents contain the whole of this Agreement between the Owner and WRAACReunited, and you concerning the Site 17 SeverabilityIf any term of this Agreement is held to be invalid the remainder of this Agreement shall remain valid and enforceable. 18 Applicable LawThis Agreement shall be governed by and construed in accordance with the laws of the Australian Capital Territory. The parties agree that the Courts of the Australian Capital Territory have jurisdiction over any legal disputes arising from this Agreement. The comment section is restricted to members only. |
